🌿 Acceptance of Terms
By accessing, participating in, or interacting with Kinward.net, the Kinward game, or any affiliated activities operated by BearDrool, you acknowledge and agree to abide by these Terms of Service.
Failure to comply may result in removal from activities, temporary suspension, or permanent banning.
1. Game and Playable Characters
1.a Acquisition
Playable characters (also called “adoptables”) are acquired through adoptable sales managed by moderators, or through group features, events, and community rewards.
Playable characters may also be obtained through player-to-player trades.
Official Kinward creatures (such as Wixxon species) will be documented in the Wixxon-ML (Masterlist).
Wixxon are a closed species — creation of new Wixxon without explicit permission, or without having earned relevant items through official BearDrool/Kinward events, is strictly prohibited.
🌿 Species Ownership and Creation Rights
Certain species within Kinward are protected as closed species, while others are open for community creation.
🌿Closed Species require official acquisition via Kinward.net, Discord, or officially sanctioned events.
Unauthorized creation of closed species without permission may result in removal or banning from Kinward activities.
Open Species are offered freely for community creativity.
Players are encouraged to respect Kinward's world themes, but no approval is needed to create Plumes, Scarves, or Embers.
🌿 Within the living weave of Kinward’s glades, some spirits are bound by sacred rites, while others bloom freely by the will of their creators.
Capras, Wixxon, and Littens are sacred beings, their bonds guarded by ancient roots.
Scarves, Plumes, and Embers stir freely among the moss, born of wildlight and wonder.
Travelers may craft companions of the open flame as they please, but only the Grove may offer sacred kin.
1.b Resale
Adoptables purchased from approved Wixxon designers are non-refundable.
All transactions for adoptables are considered final.
Resale of purchased adoptables is permitted under the following conditions:

Resale is allowed at or below the original purchase price, plus any additional commissioned artwork value and/or character upgrade value.

Adoptables earned through free giveaways, in-game events, or gifts (where no real money was exchanged) may not be resold. They may, however, be donated back to Kinward.net to be redesigned or raffled.
1.c Trading
Upon transfer of ownership to another player, you relinquish all control over the character's development within Kinward.
The new owner gains all rights to edit, upgrade, and utilize the character in compliance with these Terms.
1.d Co-Ownership
Kinward and BearDrool do not recognize co-ownership of characters.
The masterlist will recognize only one official owner.
Disputes arising from unofficial co-ownership agreements will not be mediated by staff.
2. User-Submitted Content
Visitors and players may post content provided it does not violate the following:

No obscene, illegal, defamatory, threatening, or infringing material.

No invasion of privacy, or harm to third parties.
-
Must comply with Kinward rules and guidelines.
Content (artwork, writing, submissions) must be appropriate for audiences 13+.
Gore, nudity, or implied sexual content must be properly tagged and hidden/spoilered.
Submitted content must be:

Original work or

Used with proper permission.
Stolen, heavily referenced, or traced works are strictly prohibited and may result in suspension or banning.
Staff reserves the right to edit, remove, or moderate content that violates Kinward's values, standards, or supplementary rules.
3. Copyright and Ownership
All content created by Kinward/BearDrool (digital downloads, images, texts, graphics, logos, species, lore, etc.) remains the property of BearDrool and Kinward, protected under international copyright laws.
Players who submit their own original content (user profiles, bonded creature designs, stories) retain ownership of their user-generated content.
Species Ownership:
By creating or purchasing a Wixxon design, you acknowledge that Kinward/BearDrool retains copyright over:

Species concepts

Trait systems

Associated lore and branding
You retain full personal use of your specific character designs for non-commercial purposes, provided proper credits are maintained.
You may use your owned Kinward creatures:

In external ARPGs

In personal roleplay

In non-commercial creative works
Commercial usage without express permission is prohibited.
Chargeback Policy:
In the event of a payment reversal (chargeback), ownership of affected adoptables reverts back to Kinward/BearDrool.
Chargebacked adoptables are considered unclaimed and will not remain with the purchaser.
Account Bans:
In cases of account banning:

You retain ownership of your existing purchased designs.

However, you will no longer participate in Kinward activities or earn additional designs/items.
4. Code of Conduct
Kinward values a safe, respectful, and welcoming environment.
The following conduct rules apply:

No cheating, forging records, or falsifying in-game numbers.
-
No homophobic, transphobic, racist, ableist, or otherwise hateful language or behavior.

No guilting, begging, or harassing players regarding sales, trades, or events.
-
No interference in sales, flatsales, auctions, or raffles to manipulate outcomes.

No unsolicited "mini-modding" — please allow moderation staff to address rule breaches.
Disagreements should be handled respectfully and escalated to staff when needed.
Moderation Authority:
Moderators reserve the right to warn, suspend, or ban players who violate the Terms of Service, supplementary rules, or cause significant disruption to the game's health.
Wixxon Species Protection:
Wixxon is a closed species created by BearDrool. Unauthorized duplication, commercial use, or modification outside official guidelines is strictly prohibited.
🔒 Grandfathered Wixxon Clause
As Kinward has grown, so too has our understanding of what defines a Wixxon — their anatomy, role, and place within the world of Aucuba. With this growth has come clearer standards and a more refined vision for the species moving forward.
However, we recognize and deeply value the early supporters, artists, and community members who helped shape Kinward during its formative years.
Any Wixxon created, approved, or distributed prior to the establishment of current species standards will be considered Grandfathered.
What this means:

🔸 Grandfathered Wixxon remain fully valid and recognized within Kinward.

🔸 They will not be revoked, excommunicated, or forced to be redesigned.

🔸 Owners are not required to alter, update, or “fix” these Wixxon unless they personally choose to.

🔸 These Wixxon may continue to be owned, traded (where allowed), and loved as part of Kinward’s history.
Moving Forward:

🔸 New Wixxon designs and future approvals will follow current and evolving species guidelines.

🔸 Grandfathered Wixxon serve as legacy designs, representing the growth and evolution of the project.

🔸 In lore, these Wixxon may be considered rare variants, early manifestations, or regionally divergent guardians, should owners wish to explore that narrative — but this is optional, not mandatory.
Kinward is not about erasing its past — it is about honoring the path that led us here.
📜 Creature & Wixxon Retirement Clause
Kinward is an ongoing, collaborative worldbuilding project. Participation is always voluntary, and we respect that creators’ interests, time, and circumstances may change.
Owners may choose to retire a Wixxon or other Kinward-affiliated creature at any time.
What Retirement Means:

🔸 A retired creature is considered no longer active within the Kinward project.

🔸 Retired creatures cannot participate in official Kinward events, prompts, storylines, rolls, or site-based activities.

🔸 Retired creatures are removed from active gameplay and progression systems.

🔸 Their history, ownership, and creation will be preserved in Kinward records as part of the project’s legacy.

Important Notes:

🔸 Retirement is a player-chosen action, not a penalty or disciplinary measure.

🔸 Retired creatures may still be kept, displayed, or enjoyed by their owners outside of Kinward gameplay.

🔸 Once retired, a creature is considered finalized in status unless reactivation is explicitly approved by Kinward staff.

🔸 Retired creatures may not be reintroduced into Kinward events, trades, or canon storylines without formal review.
Kinward honors the time, creativity, and care that went into every creature, whether active or retired.
🔁 Ownership Transfer of Retired Creatures
Retired Wixxon and other Kinward-affiliated creatures may be sold, traded, or transferred at the owner’s discretion.
Important Clarifications:

🔸 Transfer of ownership does not alter a creature’s retired status.

🔸 A retired creature remains retired regardless of ownership changes.

🔸 New owners may not participate in Kinward events, gameplay, rolls, or canon storylines with a retired creature.
On Reactivation After Transfer:

🔸 New ownership does not grant reactivation rights.
-
🔸 Reactivation requests remain exceptional, rare, and staff-reviewed, regardless of who owns the creature.

🔸 Kinward staff reserve full discretion to approve or deny reactivation without obligation.
Retirement is considered a status of the creature, not the player.
Kinward does not mediate or guarantee third-party sales of retired creatures.
Buyers should understand a retired status prior to purchase.

❓ What is the difference between Active, Grandfathered, and Retired Wixxon?
Active:
May participate fully in Kinward events, gameplay, and canon storylines.
Grandfathered:
Legacy Wixxon created before current standards. Fully valid and respected, but may not reflect modern design guidelines.
Retired:
No longer participates in Kinward gameplay or events. Preserved in records but considered inactive.
❓ Can a Grandfathered Wixxon be retired?
Yes. Grandfathered Wixxon may be retired at the owner’s discretion and will follow the same retirement rules as any other creature.
❓ Can I redesign or update my Grandfathered Wixxon?
Optional.
Owners are never required to redesign Grandfathered Wixxon.
If changes are made, the Wixxon may be reviewed to ensure alignment with current standards.
❓ Can retired Wixxon still be displayed or used outside Kinward?
Yes.
Retired Wixxon may still be owned, displayed, written about, or enjoyed outside of Kinward’s active systems.
They simply do not participate in Kinward gameplay or events.
❓ If I sell or trade a retired Wixxon, can the new owner use it in Kinward?
No.
Retirement status follows the creature, not the owner.
Ownership transfer does not grant reactivation or participation rights.
❓ Can staff revoke or force-retire a Wixxon?
Only in cases of severe rule violations or unresolved disputes.
Kinward does not revoke or retire creatures lightly.
❓ Can I leave Kinward without retiring my Wixxon?
Yes.
Leaving the community does not automatically retire a creature. Retirement is a separate, optional choice.
❓ What happens if Kinward changes again in the future?
Kinward is a living project.
Major changes will always be communicated clearly, and legacy designs will be respected through grandfathering when appropriate.
❓ Can retired creatures appear in lore or archives?
Yes — as historical or legacy figures.
They will not take part in new canon events unless explicitly approved.
